A Case on Fight after Accident in LDP




Hi guys, this post of my Business Law studies includes videos that we can discuss on. The first video is an accident of some drunkards while the second is a slight bump from the back, but resulted to a serious fight in the busy road of Lebuhraya Damansara Puchong, nearby St. Ignatius Church and LRT Station. It happen during the peak hours of LDP on 16th January, if I'mt not mistaken. This videos had brought in over 400 comments in one of the Youtube account and several others as well discussing on who is right and who is wrong.

Before you watch the video, there are some things to note.
1) The pink shirt guy is a mid-adult man soon to turn 38 as his birthday is on 2nd February (sources un-identified) and he is driving the Proton Gen-2 (WQB 2798)
2) The red shirt guy is a young adult, driving Proton Wira that bang the Gen2 from the back. Actually, just a very slight 'kiss' that the dent or scratches is rather not obvious
3) *IMPORTANT* The baseball bat is the belongings of the pink shirt guy. Look at pictures below


And from the video, there are some funny things that happen.

1) The red shirt guy threw the bat away in the middle of the fight
2) The red shirt guy threw again
3) The pink shirt guy is bathed with blood, but still want to fight.

The speculation goes like this,
I won't continue my post with much personal thoughts, as I will do more ground research this time especially on whether how this lawsuit can be pursued, if it is really going to happen. Who is right and wrong, is hard to judge, especially seeing from the comments from youtube.

But we will start the warm up with,
1) Why do the pink shirt guy come down with a baseball bat? For protection or to scare people?
2) How did the fight started, who started in fact?
3) Why a small case will break lose to a big fight?
4) Why realising that the pink shirt guy bat is snatched, which mean he is un-armed, why did he pursuit to his disadvantage? Is it he is afraid that he might be attacked or a robbery can occur or protecting his wife/girlfriend?
5) Why did the red shirt guy threw the bat away?
6) Why did the pink shirt guy still attacking the red shirt guy after the bat is thrown, is it to his advantage or is he revengeful?
7) How was the matter solved?

With that, I will close this post and continue tomorrow for more research. Enjoy the video guys, and we also have to learn to give and take. The case as many had observed can be solved with RM 50 - RM 200 but end up with more damage, for now, yes it is just a 14 stitches on the head. But in long term, we never know. And for the red shirt guy, how is his conscience if happen the guy had a coma, or any of them was banged by a car when they fight?

A Case on Roslin Hashim

Hope you guys know who is this guy! Anyway, this might be a controversial post that I'm doing, so if you don't really agree, don't bash me off with cyber-troopers and put down this blog. Let's make it a healthy discussion and also basically to start up with my subject that I'm taking this semester, namely Business Law. But how is it related, for former national and World Number One badminton player to do with any law and legal issues that I'm going to discuss.

The first post is in English while the second is in Malay. The second articles provide more details and if any of you all who don't know how to read the post, you can let me know, I don't mind translating for you guys (for my classmates I mean).

The freedom of speech is literally practise in Malaysia. But freedom of speech practise in the world of blogosphere might be a real different story because the moments the button "Publish Post" is clicked, you may have the whole wide world, the access to view every opinions to have. Whether is defamation or accreditation. Anyway, use your rights properly, for everybody including me, I hope.

Alright, the issue of Roslin Hashim and his wife, Faizah Mohamad goes like this. They got married on 30th June 2009. Kiss, hugs, SEX and 12 days later, divorced. Nobody can really understand what exactly happened, until, Roslin personally revealed the suspense - simply - he couldn't get Sexual Satisfaction from her. Very bold words especially from our national player and so-call celebrity who is a role model for Malaysian sports scene. And upon divorce, now he had filed another lawsuit against her, to claim for all the expenses and etc. that they both used during the preparation for their marriage, which includes, the engagement ring, wedding ceremonies, including canopies, video and hotel rooms (sources from Malaysia Today) which totaled up to RM 53,460 and the law suit will be on March 23rd and 24th.

So guys, what do you think? Is it appropriate to bring up such a case if you are in this situation? My guesses goes like this, if you are from a small town in Malaysia, chances are high you will not. But from my Law friends knowledge, working in Sri Hartamas, every week they have at least 10-20 files to open, which nearly a quarter involves family or divorce law. Truly and sadly though, but YES. The culture in the more developed places in Malaysia is having this crisis, and my friend as a lawyer, had told his boss to not give him any lawsuits on divorce cases because on the surface we know, is all about the payment. But on the inner, the case that involved having children is so sad that, one party will demand more hours and days to meet the kids, while the other will only allowed a certain time and place for them to meet. It is just like how sad we can see Britney Spears case, in fact.

Back to our topic on Roslin is that, will you be daring enough to do what he did? Let's just talk on law and legal rights, comparing to emotional stuff. Will you be daring enough? For money or for rights?

The reason I discussed this is with the hope that I can find the answers. That their lawsuit are filed under the Syariah Court. And all I want to know is that, in Syariah court, is there rights that regard a husband must be fulfilled their sexual satisfaction or fantasies, in any or every way a lady could? Also, to be more debatable, in Syariah ruling, revealing the problem of a divorce due to sex, and is the reason conclusive?

I wrote in forum post regarding this issue, as this post won't just conclude the actual rights. I have wrote to Woman Aid's Organization, and on Sharia Law In Malaysia forum regarding this scenario for the ruling of civil and Syariah courts.

My questions are throw out this way,
To WAO,
1) For the wife side, as she is not the one that claim the lawsuit, and the lawsuit is in Syariah court, can she be claiming any rights for his man to disown her without knowing her properly?

2) Although the scope is in Syariah law, can she make another lawsuit on civil court for defamation and inability to understand her?

3) A pursuit on him, in any rights, or sections of a woman to say that Roslin behaviour is inconsiderate and did not respect the woman and her sexual ability?

And on the Syariah Forums,
1) Is it the rights of a MAN, to divorce their wife due to her inability to satisfy his sexual desire?
- addition question, "...in such a short period?"

2) Is there rights of a WOMAN, to counter stating that he did not give ample time for her to learn or cultivate the knowledge to satisfy her man? (as both are virgins, no sexual experience, I believe)

3) Also, in Syariah ruling, is the WOMAN allowed to pursuit a legal suit not just in civil court, but Syariah as well due to defamation of her?

We have to know the contain, as back in 2003, Divorcing through SMS or Text Message is allowed in Malaysia. Also in Saudi Arabia.


However, as speculation may be the forte of Financial Engineers, let's round this post up, before I update my post with the results from WAO and Sharia law forums, and law friends and even my lecturer. hehe..

For the rights of Uniten Nation's Convention on the Elimination of All Forms of Discrimination against Women(CEDAW).

From article 1 on "Discrimination on CEDAW",
PART I

Article I

For the purposes of the present Convention, the term "discrimination against women" shall mean any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women, irrespective of their marital status, on a basis of equality of men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field.
Apart from that, from South-East Asian Syariah Womens Rights, did mentioned the below

"The section 52(h) definition of unusual cruelty by the husband includes that the husband habitually assaults her or makes her life miserable; associates with women of ill-repute or leads an infamous life; attempts to force the wife to lead an immoral life; disposes of her property or prevents her from exercising her legal rights over it; obstructs her in the observance of her religious practices; or, if he has more than one wife, does not treat her justly and equitably as enjoined by Hukum Syara’. The husband may also apply for fasakh if the wife is incapacitated such that she is prevented from having sexual intercourse."

There are many sections and laws in Suhakam, Malaysia Bar for Civil Courts and Syariah Courts of Malaysia, thus, the point of views will come in the next update. But for now, on Roslin side, he probably have this section to back him up..

1. The rights of a husband in a marriage

It is often believed that once a woman is married, she is her husband’s property and the marriage contract is an entitlement to sex. Sir Matthew Hale, Chief Justice in 17th Century England wrote:
“ The husband cannot be guilty of rape committed by himself upon his lawful wife, for by their mutual matrimonial consent and contract, the wife hath given herself in kind unto the husband which she cannot retract.”
Perak Mufti Dr Harussani Zakaria would seem to support this same thinking when he was recently quoted as saying that the act of a husband forcing his wife to have sex with him cannot be construed as rape and as a wrongdoing in Islam:
“A husband has the right to be intimate with his wife and the wife must obey. If the wife refuses, the rule of nusyus (recalcitrant) can be applied and the husband will no longer be responsible for his wife (23 Aug 2004, The Star).

But honestly speaking, you love your wife not just because of sex only right, and definitely to divorce her with a reason because of displeasure in sex. I mean, it is not absurb but rather abnormal. It is not like any side is impotence that in Syariah law the lady have the rights to divorce. And in such a short period that is 12 days! For some people in Malaysia, maybe they don't even have sex even after married for 12 days, in fact! Simply, sex may not be the main thing for a matrimonial.

Because if sex is that important, so much important that you might be afraid to land like how Tiger Woods did, 14 ladies, with lots of prostitutes and pornstars. But personal or emotional opinions are not debatable in LAWSUIT, unless you have evidence. That's why we need religious laws like Syariah or the Book of the Bible. In Catholic faith, once you divorce, you are straight going to hell when you die. Because in the Book of the Bible, stated in Corinthians or Thesolonians, as far as I remember, when you are having Holy Matrimony or simply, Marriage, two hearts will become one. So if you break up and divorce, each of you have only HALF a HEART, thus, you are in-human!

While looking on the poor wife, I believe Woman Aid Organization might have a good advise if this scenario reach out of hand. Let's hope for the best and pray that this type of scenario won't happen that often in Malaysia anymore.

Facts that you hate: Sex in Thailand may not be legal, but in practise it is tolerated and regulated (sources from Wikipedia.org/Prostitution in Thailand). And from what we know, for a lady boy to service you, the price will start from 150 baht, while female service is starting from 300 baht!(sources from the hotel owner that I stayed in Phuket) Yes, it is, the FACT that you HATE!

Genius

Sometimes, I really want to look back at those people that I know in ~my life~ and truly give it a smile, to know a lot of friends with lots of variations, characteristics, charisma, patterns, styles and last but not least, smartness! Yeap, I bet you guys have some of your friends that you couldn't even think how they do it! Salute to that! haha..

Let's talk about this friend of mine, who plays DotA nearly everyday in his secondary school, up to a stage where he is rob in the Cybercafe, after rested 2 days, he and his gang went back to the same CC to play. Everyday in school, you will see him lying on the table - sleeping! May not be the worse student who play truancy, but definitely the worse in his class - He is in the first class by the way! Never care less for his studies, still doing the same thing and yes, Straight A1 it is! Easy pickings for him and now in Germany, on a full term scholarship! I bet a lot of my friends will know him as his name is just how regular you will know think of him.

Let's talk another case. A friend that never complains, always keep things to herself. Not a baby geniuses type, but a real geniuses characteristics. Winning points is DISCIPLINE! Her discipline is truly her strength in doing everything nicely, even in her hard times, she always pull it through just nice. Is like a spring that never breaks, a coil that always strike on time! How wonderful it is! Of course, hardwork had been put off, but in any situation that is thrown to her, whether you want to comment how tough or hard an assignment or exams for her, she is always there, standing readily for the paper or ready to bounce back anytime soon. And you stood there looking, there are so many geniuses that can do so many things, and you will find yourself digging the ones that you truly like of their characteristics. Human in fact, everyone likes to complain. I'm talking on behalf of myself that is the direct opposite of my friend, she never complains, I COMPLAIN DAMN A LOT, so much so that my GOD, probably might send Angel Gabriel to me and says, "Eric, you should just take some time off and stop complaining!"haha.. The level of complain that my friend did, is the lowest in the people that I know, which include my second brother, Alban's friend, who is the same - and done perfectly well in his career (a relation was done- they are from the same state). It is truly rare to find people that seldom or never complains, and is like everything is done just as it is. And never fail herself and never fail for me to observe how much salute she can receive. Whether the lecturer is having no backbone, or the assignments is as tough as you are meeting a hard-nut customer, or whether you having flu, A(H1N1) - the strong self perseverance brings to who she is right now! Truly salute that!

And then, going to the nerd category, whereby you know, NERDS! But guys, open your eyes bigger abit! NERDS may not be exactly be a geek, full of knowledge, but nothing but the knowledge those type of people. Some nerds are geniuses that you don't even can think how they can remember every single algorithm to construct, let's say a program that auto-trade for you Foreign Exchange. He can be laughing and jovial as ever, studies like a NERD, play like a PERK! But you can never think that one can reach a level to construct a full program, workable auto-trading software with ten or hundreds of thousands of programming lines, few hundreds of logic within, less than a week! And trading now, on good market with 20% margin return! GODLIKE!

IT is hard to say who is genius or smart and stuffs. Sometimes without realising you are being given that smartness. For people who didn't get it, and not having those qualities, it is not within our control or maybe, we are not on those field. But never be jealous or envy about it, admire those people. It is truly great to feel good about others, it gives you a sense of relieved that you are able to meet them. We are all given with the same size of brain, we work on it you will get it I believe. But truly at the end, is the DISCIPLINE that matters that makes that someone doing great. For me, I'm never a discipline person, and that explains why! hahahaha..Look around and find yourself people that you think damn freaking smart! Enjoy their characteristics and personality, and you might find some in you! Take it and GO!

Arson attacks in surau, but out of so many places, why Muar?

Hi guys, another so-call political post. If you know me personally, yes I like politics just as much as gossips I can say. Politics is fun if you are truly 'gentlemen' to hear it. Oh no, I shouldn't say that gentlemen word, or it will be the same case whereby Mr. Karpal Singh slammed on MACC Abdul Razak by commenting, what type of English he is using, "Gentlemen?".

Anyway, back to the title. It had been so many arson attacks in Klang Valley and part of Johor, and definitely we as the citizens are terrified. We never know when or where these unscrupulous attacks might happen and definitely, we should all condemned of such lowly-sickening act, because after all, it is a place of worship. Just like as always the saying goes, that you can always speak, just like those politicians, speaking like nobody business. But what comes from tongue, goes back to tongue. Let the tongue do the job, but not the actions. We can't say, STOP to all these things, as you know, "Tongue is the deadliest weapon", since it is started, let those that are responsible take the rightful actions.

The reason why I wrote this post that state, why out of so many places, Muar is the place that have this attack. Don't get me wrong, I'm a Muar-ian, and definitely, hearing such cases, we are definitely saddened. My hometown, the hometown that we are so proud of. The hometown whereby Namewee was found as well. And why this startling political stuff to be done in Muar? Muar used to be the place where lots of gangsters and Ah-Longs resides, but they had soon changed, so much long ago to be a better citizen for Malaysia. No more fightings, no more arson, killings and etc. They venture into business and having their kids study as much as possible - so much so that, Muar, is a very kiasu place for studies. You will be surprised?

Growing up in Muar, you will know why your level of literacy are slightly more competitive to the others. Not that other place do not have, Muar is slightly more intense. However, this is not a bad thing. People tend to get more literate and in fact, with lesser gangsters and those juvenile cases, Muar become one of the more peaceful place, in spite of her background. Friends, neighbours, hawker stall aunties uncle, mamak stall makcik pakcik akak abang, and all sort, are so friendly that whenever I go back, it is so hard for me to go back to where I am now, in places where too much selfishness exist. Muar is so much peaceful not after those people did such things this morning.

As Mr. Lim Kit Siang said, it is true that after so much peace, I truly thought that it will soon come to an end of this sensitive issue. However, it is brought back again. This time in Muar. Sad and angry in fact!
If this is meant for political issue, please let those politicians and people with knowledge to resolve what they want to do. Whoever who did that, please be responsible, because even if your General or Commander, is the one who ask you to do that, you are prosecuted! Please feel guilty about yourself. One thing is that, in a war, soldiers may not know everything, but at least they work together well. They fight face to face, not backdooring. If you think, you play too much dota, then you can go to NT Internet Cafe to challenge those players.
This no longer become a joke for such issue.
In fact you guys may not know, some of the church parishioners in St. Andrew, have been taking care of the church every night since 10pm to 6 am in the morning, ever since the first 3 incidences that happen in Klang Valley. As many of them thought last week, they can have a good rest at home, and to be able to work well the next day, Kota Tinggi church and another Seremban church attacked.

Soon, with much relieved this few days, and today, in my very own hometown, this things happen. So to the guys who attacked the surau, I can say this to you, "What the Fuck do you want?". Do you know how hard for those uncles and aunties, to work in the middle of the night, imagine if it is your parents who is taking care of the church or surau or Sikh temple. Yes! This is a serious issue, but all I can say is, "This is none of your fucking business anymore!". Politicians have their views, have their own perceptions, yes, I know. Pakatan Rakyat VS Barisan Nasional. So what? So what if you attack the surau, church, or temples, do you make a headline out of yourself, or make a fool out of yourself? Do you think you can stand in the position where those politicians can stand and talk. If you want to talk like a politician or work as a politician, study more, learn more, observe more and comprehend more of the situation and not just making a mere chaos to the flame that will soon burn your butt.

Everybody wanted to put a big FULL STOP to this issue, let's work on putting that, not erasing that. Come on, you probably don't use much eraser when you are in school okay, brats!


p/s: in Muar, please stop those issue, before those great gangsters come back to their job and do what they do best. Let's put an end to that! Thanks!

2010 - The NewComings!


Yes, the brand new year hopefully with the brand new stuff. This is the year I will be so-called graduated and entering the working life - something that I'm eager yet reluctant to put myself to it at the mean time. However, still enjoy every moment that can be enjoyed for now. And thank MMU for the very first time before me and my batch graduated, that Christmas Day and New Year we can celebrate without worrying about our finals. So you can imagine the delightful us way before we are actually celebrating. Three weeks plus of holidays had passed so fast and it is definitely the relaxing holiday that I wanted, after my hectic 2009.

This holiday itself is a blasting experience in fact. Have been doing a lot of visiting that my usual holidays and had not been hitting the swimming pool, gym or driving range that much. Spend less time on computers onlining but spend more time to pick up back what is left in early 2008, DotA! Get in routine and having a standard procedures and template on doing what my stream of cash flow is. Been reading more than usual, maybe last time holiday read one page, now 3 pages. Improvements, that's it! hia..

In short, also, a coincidence chance by fate that Christopher, Benedict and me had the same holiday. Chris graduated 6 months ago and is still 'graping' (meng-ANGGUR), while Kiat is completing his one last semester before hitting his career just like me. Kiat and I both have holidays, and definitely our girlfriend as well. Chris' girlfriend is back from Aussie, so what better plans to meet up for one last time as it is very hard for us to meet up as Chris is going to Singapore soon, Kiat is going to the industry that in needs a lot of his commitments especially to his band, and mine, to the conglomerate of Sime Darby.

It all started as a plan to just nearby places called Pangkor Island, apparently Chris and me who is supposed to DotA that night end up thinking lots in one MaMak stall. From Penang, to Langkawi, to Pangkor, to Desaru, to Redang (oh no, monsoon!). The finalist to be selected was Penang, Langkawi and with priority on Pangkor. And when we were back checking our flight tickets, apparently the 'cheap' us thought, 'Hey, Phuket is cheaper (in terms of flight)!' thus we set our cruise to it. Lots of funny stuffs happen after that but it was Phuket, but without Kiat and Jenny (his girl).

The Year by the Name 2009!

Yope! The year 2009, by its name is truly a great year for me. Venturing into new things that you never think you will go into and further your experienced with some skills and knowledge that you never think you will enhanced.

It is by then I realised the real and true meanings of opportunity comes and go, and to learnt how to pick up, to let go and truly be yourself at the end of the day. But why? Simple as life have to go on.

Living 2009 truly go beyond what my resolutions for this particular year. Though I did not achieved all of them, but I did achieved something others. Something that teaches me the principles of life, something that touches me that life can be the other way around and something that you can actually start doing even at this age.

However, 2009 lived a story behind it, share it slowly though. But pre-2009 have something new for my experience as well, that is attending for the first time Malaysian Philharmonic Orchestra. That can be said as part of my assignment for my subject Music Appreciation, but definitely a worthwhile experience to listen to the piece dedicated to Brahms. The conductor that day was Osmo Vanska while the solo pianist that thrills the whole stage was Marc-Andre Hamelin. An experience to blow!

In Memory of Andy Gan...



On 3rd of January 2009, at 11.34pm, one of the National's Best Golfer had been called by the Lord. With all respect, Andy Gan Hsien Loong, born February 24th 1988, at the age of 21+ had peacefully left us.

I personally do not get to know him that well, but definitely we had 2 rounds of golf before, both in competition (back then when I'm still active), with him representing Selangor and my pack then, Johore. He is definitely one of the most prominent golfer back then not just because Selangor team is strong, but he is the anchor of the team. A friendly guy just like how he looks, Andy played really well and pursued his dream in golf - professional golfer, definitely. Being able to climb that hill and to continue climbing that hill in golf arena is not easy, especially in Malaysia. Probably he is able to do that because he had been slim while I'm always fat, so I did not give up, but did not continue that passion enough (sorry to crack such a thing at this time, it is in me, so to Andy's fans, no offense alright!).

It was unfortunate that during some time after I did not continue to be active in golf, I got to know that Andy had leukemia. Back then, I was really shocked hearing from Melanie (another prominent female golfer in the making and she if from Johore) regarding Andy's condition. As we all know, Facebook is so popular already back then, I went and send him some greetings. And, to my surprise, and to the joy of everything as a friend, Andy responded and still remembers me which tells me two things (FYI, I'm not that popular). One is Andy got a good memory to remember me, or two, I'm so fat back then that it is too hard not to notice me (sorry again Andy's fans!).


A few more greetings were sent to him as well, during his birthday and etc. And definitely when come to reflection time each time I see his Facebook, I will think, "This guy Andy is really damn freaking strong (not that I want him to be like now), but in the sense, he look healthy and joyful everytime!". That is COURAGE dude! Guys and gals, how many of you all can think that at this point of time, realising that you are in such stage, will have that strength to be so jovial and jumping like a monkey like him (guys, hope you understand what I'm trying to say). To pick up everything that is drastically falling apart, is simply not easy. Truthfully, all my salutations that I have in my life, will go to you Andy. And that I only get to know that, he blogs about this.

I only get to know his blog past few days and in my conscience, this is not those ordinary blogs that blab about life, those life or fantasy life you live in. This blog is nothing, but wholeheartedly from Andy's word, to say how lucky he is to cherish every moment and seconds in his life.


He is very passionate about golf, that golf was just about his life. But challenges bring him to this stage. I always thought that he is recovering so fast that he might be back in golf sometime soon. As the naive mind of mine that thought that leukemia is not as serious as cancer. I was wrong! Totally WRONG!! Again, Mel told me that when we see that he is strong, he is hiding everything behind his graceful smile. It was such a surprise for me because I truly hope to see in the golf arena back again, really soon actually. And noob mind in medical stuff of me, to learn that leukemia is so much tougher to overcome than cancer patients.

Thus, to my dear Andy Gan, your life is full of adventure, so much so that you brings that adventure to us, and inspire us with your every courage, passion and love. I, wholeheartedly was touched by your every actions to truly take every steps at a time. While we are blundering our life like there are always tomorrow, some others are always hoping for tomorrow. The passion is never unburned!

Hey guys, updates and updates and updates! haha..This blog is probably left very much unattended, truly unattended. The passion to blog never stops actually, practically because I talk way too much that I find no one to talk to that I turn to my computer. haha..That maybe the case I think!

Anyway, 2009 was a great year, less turbulence, but lots of mishap as well. But still, live a life that way unexpected, more exploration - more challenges - more things that use your big brain to think!

Life's like that so be it! Anyway, throughout 2009 I wanted to raise my website of www.ericseah.com, I create a reasonable look template, but couldn't transport a lot of things and construct it to complete, leaving the prototype until it apparently expires. During November, I was thinking whether to keep the site, and finally, I don't even have time to think whether to continue or not and finally drop the idea. No commitment for now on website and probably when I'm free only I'll do that website back again. But still, interesting stuffs streams through my life, so here I am, blog to you..after so long...listen or not, this blog is for the leisure to share, crap and inspire! Take it and Go!
